Updated November 2026 · Written and maintained by the Progression Agency strategy team
Hiring an app development company in Texas now means planning for a state app store law whose injunctions have been on hold since June 2026. As of November 2, 2026, the Fifth Circuit’s stay stands, the Supreme Court has denied the application to vacate it, and the appeal may still change this. This page sets out six release gates for an app reaching Texas users, from age ratings and consent signals to privacy, biometrics and AI features, then the costs. It is for founders and product owners, and it is not legal advice. Progression is based in New York and builds for Texas clients remotely, with on-site sessions on request.

The short answer As of November 2, 2026, Texas’s app store law is operating under a stay pending appeal, so the planning question is not whether it applies but what each release must carry. The six gates below are age ratings, age signals and consent, store notices before updates, a privacy screen, biometric features, and AI and social features. Each one says what the statute says, who should own it, and what to ask counsel. We state what the laws say and never that an app complies. A stay is not a final ruling, and the appeal may yet change part of this.
The court dates are from the Fifth Circuit’s June 4, 2026 order, the Supreme Court’s July 6, 2026 order list and docket, a party’s case page and a law firm’s alert, each linked where it appears. The statutes are cited as enrolled bills on capitol.texas.gov. Amendments after the bills named are not covered here, so confirm the current code. Check the Fifth Circuit’s opinions page for any merits ruling, and ask counsel. Nothing here says that any app or store complies.
Where the Texas app store law stands on November 2, 2026
Texas’s App Store Accountability Act, SB 2420, adds Chapter 121 to the Business and Commerce Code. The table gives the dates in order, with who said each. Ask counsel what it means for a given app.
| Date | What happened | Who said it |
|---|---|---|
| December 23, 2025 | A federal district judge granted a preliminary injunction against the law, as described by one of the challengers | CCIA’s own case page, a party to the case |
| January 1, 2026 | The law’s stated effective date | The enrolled text of SB 2420, Section 3 |
| May 28, 2026 | The Fifth Circuit temporarily stayed the injunction while it considered the state’s motion | A law firm alert, read in full |
| June 4, 2026 | The Fifth Circuit granted a stay of the injunctions pending appeal, saying Texas has made a strong showing that it is likely to succeed on the merits | The court’s published order, filed June 4, 2026 |
| July 6, 2026 | The Supreme Court denied the application to vacate the stay, with no reasons given | The Court’s order list and docket 25A1390 |
A stay is not a final ruling. Check the Fifth Circuit’s opinions page for any merits ruling. A Wiley alert says the Attorney General can enforce the law during the appeal. The appeal could still change this.
What does a stay pending appeal mean for a developer?
The district court’s injunctions are paused while the appeal goes on. The order was a stay, not a decision on the merits. We make no prediction, and counsel should say what applies to a given app.
App development in Texas: the six gates in release order
App development in Texas now comes with a release checklist, and the appeal may yet change part of it. Mobile app development in Texas reaches the law when an app is made available to users in the state through an app store.
- Gate 1: scope and age ratings
- Gate 2: age signals, parental consent and deleting the data
- Gate 3: the change notice before a significant update
- Gate 4: a privacy screen under the Texas data law
- Gate 5: face, voice and fingerprint features
- Gate 6: AI features and social features
Android app development in Texas and iOS work meet the same text, which speaks of app stores and not of platforms. We state what the laws say, never that an app complies.
Does the law reach a developer based elsewhere?
Section 121.051 says the developer subchapter applies only to the developer of a software application that the developer makes available to users in Texas through an app store. Whether a given build is covered is a question for counsel.
What an app development company in Texas should own at each gate
Among app development companies in Texas, the useful test is who owns each gate. The table lists what a team hands over and who signs off. Those artifacts are capability claims and not guarantees.
| Gate | Artifact the team hands over | Who signs off |
|---|---|---|
| 1 Age ratings | A rating sheet for the app and for each purchase, with the content behind each rating | Product and counsel |
| 2 Age signals and consent | A build that reads age category and consent status, and handles a revoked consent | Product and the store account holder |
| 3 Change notices | A release checklist line for the four triggers | Product, counsel and the store account holder |
| 4 Privacy screen | A request process, a notice and a data map | Counsel and product |
| 5 Biometric features | A notice and consent step before capture, and a deletion schedule | Counsel and product |
| 6 AI and social features | A feature list marked against the two statutes | Counsel and product |
An app developer in Texas, or mobile app developers in Texas, can build the artifacts but cannot decide what the law requires. App developers in Texas should expect counsel to own the questions. A Texas app development company that offers to certify compliance is offering something we do not. See app development agency.
Gate 1: scope and age ratings
Section 121.002 defines an app store as a publicly available website, software application or other electronic service that distributes software applications from the owner or developer to the user of a mobile device. Whether web apps and side-loaded builds fall inside that is a question for counsel.
| Category | Age |
|---|---|
| Child | Younger than 13 |
| Younger teenager | At least 13 but younger than 16 |
| Older teenager | At least 16 but younger than 18 |
| Adult | At least 18 |
Section 121.052 says the developer must assign an age rating to each application and to each purchase that can be made through it, using those categories, and give each app store the rating and the specific content or elements behind it. Section 121.056(b) says a developer is not liable under that section if it uses widely adopted industry standards consistently and in good faith. Read each store’s current developer documentation, because we describe no store’s tools.
What goes on a rating sheet for each in-app purchase?
Keep a sheet with four columns: the item, its category, the content reason and who approved it. It is the artifact Section 121.052 implies.
Gate 2: age signals, parental consent and deleting the data
Section 121.024 says the store lets a developer access the age category and consent status for each user. Section 121.054 says the developer must build a system that uses that information to verify each user’s age category and each minor’s consent.
Section 121.055 limits use of that data to enforcing age-related restrictions, complying with law and building safety features, and says the developer must delete it on completion of the verification. Section 121.056 lists what counts as a violation, including enforcing terms against a minor without consent, knowingly misrepresenting a rating and sharing the data. It also says a developer is not liable under Section 121.054 if it relied in good faith on the store’s information and otherwise complied.
Section 121.022(e) says the store obtains consent for each download and purchase and notifies the developer if a parent revokes consent, so the build needs a path for revocation. Section 121.022(h) lists exceptions, such as certain emergency services apps.
Mobile app development in Texas when teens are users
Mobile app development in Texas has to account for two teen categories, younger and older. Screens may need to change by category. Ask counsel which screens a given app needs.
Gate 3: the change notice before a significant update
Section 121.053 says a developer must notify each app store before any significant change to the app’s terms of service or privacy policy. A change is significant if it does one of four things, set out below.
- Does it change what personal data is collected, stored or shared?
- Does it change the age rating or the content behind it?
- Does it add purchases or ads?
- Does it materially change functionality or user experience?
Any yes goes to counsel before release. Whether a change is material is a judgment call for counsel.
Section 121.022(g) says that when a developer gives notice, the store notifies any parent who consented to a prior version and asks again. Tie the checklist to your release calendar, so the question is asked before each ship date.
Which updates trigger a notice?
Any release that changes data collection, the rating, purchases or ads, or functionality in a material way. Counsel decides what is material.
Gate 4: a privacy screen under the Texas data law
The Texas Data Privacy and Security Act, HB 4, takes effect July 1, 2024 as enrolled. Its text applies to a person that does business in Texas or produces a product or service consumed by residents, processes or sells personal data, and is not a small business as the federal Small Business Administration defines it. Later amendments were not checked.
Section 541.107 still bars a small business from selling sensitive data without consent. Exclusions in the text include state agencies, financial institutions covered by federal law, HIPAA covered entities and business associates, nonprofits, higher education institutions and listed utilities.
Consumers may confirm and access data, correct it, delete it, obtain a copy and opt out of targeted advertising, sale and certain profiling. A controller must respond within 45 days, with one 45 day extension, offer two or more secure request methods and may not require a new account. Sensitive data includes precise geolocation, a health diagnosis, biometric data processed to identify a person and the data of a known child, and it needs consent.
A privacy notice has required contents. If a controller sells sensitive personal data, the notice must say: “NOTICE: We may sell your sensitive personal data.”, and there is a similar line for biometric data. Make both build items. Enforcement belongs to the attorney general alone, with a 30 day cure period, a penalty of up to $7,500 per violation and no private right of action.

Gate 5: face, voice and fingerprint features
Texas’s biometric law, Section 503.001, says a person may not capture a biometric identifier for a commercial purpose unless it informs the individual first and receives consent. The Attorney General’s overview lists a retina or iris scan, fingerprint, voiceprint and a record of hand or face geometry, and says they must be destroyed within a reasonable time, no later than one year after the purpose expires, unless an exception applies.
The Attorney General’s overview says the office has exclusive authority and civil penalties of up to $25,000 per violation. The statute text here is the version from before the 2025 amendments, so confirm against the official code.
HB 149 amends the section. Its enrolled text says an image online is not consent unless the individual made it public, carves out AI training unless a system is used to uniquely identify a specific individual, and carves out security and fraud uses. If a biometric identifier captured for AI training is later used commercially, the section applies again. A phone-level unlock is a question to ask: whether any identifier reaches your servers. We reach no conclusion. See computer vision development company.
Gate 6: AI features and social features
Two kinds of feature meet two different laws. Ask counsel which applies to a given app.
What does the 2026 AI act say about chatbots and models?
HB 149, the Texas Responsible Artificial Intelligence Governance Act, takes effect January 1, 2026. Section 552.052 bars developing or deploying an AI system that intentionally aims to incite or encourage self-harm, harm to another person or criminal activity. Section 552.056 bars building or deploying one with intent to unlawfully discriminate against a protected class, and says a disparate impact alone is not enough. The disclosure duty in Section 552.051 is written for governmental agencies, with a health care provision at subsection (f).
The attorney general has exclusive authority, there is no private right of action and a 60 day cure period applies. Civil penalties include $80,000 to $200,000 for each uncurable violation. See AI app development company.
Does the SCOPE Act reach profiles and feeds after July 2026?
HB 18, the SCOPE Act, applies under Section 509.002 to a digital service that lets users socially interact, create a public or semi-public profile and post content others can see, with listed exclusions. Duties include age registration, limits for known minors such as no targeted ads and no precise geolocation, parental tools and algorithm disclosure.
On July 24, 2026 the Fifth Circuit’s opinion in the SCOPE Act cases held that the monitoring and filtering requirement challenged by one set of plaintiffs is preempted by Section 230, that another set lacked standing on several provisions and that their challenge to the age-verification requirement is foreclosed by precedent, and it vacated and remanded in part and affirmed in part. The outcome differed by plaintiff and provision, so we make no summary of whether the law is blocked, and counsel should say what applies. See social media app development.
App development companies in Texas: what the gates add to a budget
Hiring app development companies in Texas for a regulated release adds scope. The build work for the gates and counsel’s fees have no published band, so both are quoted after a written scope.
A mobile app development company in Texas can price the build, and your counsel prices the legal review. App development companies in Texas are compared best by who owns each gate. See app development cost.
Published bands by app size
The bands are published US figures, not Texas figures, and they exclude the gate work.
| App size | Published US band |
|---|---|
| Simple app or MVP | $15,000 to $80,000 |
| Mid-complexity app with payments, integrations and an admin panel | $60,000 to $150,000 |
| Complex or compliance-heavy app | $150,000 to $500,000 |
Mobile application development companies in Texas, metro by metro
The gates apply statewide, as the statutes read. Three metro pages cover the local market, and none repeats it here.
| Page | What it covers |
|---|---|
| App development in Austin | The Austin market |
| App development in Dallas | The Dallas market |
| App development in Houston | The Houston market |
| Software development in Dallas | Non-app software in Dallas |
Mobile app development companies in Texas should get the same six questions in every metro. San Antonio and other metros have no page here.
